Terms and Conditions
1. The 'ART of - Events', such as Ballet Winter or Summer Courses/Stage de Danse D'été, are organised by 'Klymyuk, ART of' and are referred to as the "organisers" in this Terms and Conditions document.
2. By submitting the application form, you or your parents/legal guardian acknowledge full acceptance of the Terms and Conditions of the 'ART of - Events', such as Ballet Winter or Summer Courses/Stage de Danse D’été.
3. The purpose of the 'ART of - Ballet Winter or Summer Courses/Stage de Danse D’été' is to provide an educational opportunity for ballet students and professional ballet dancers to enhance their technique and artistry. Participation in the course is a privilege, offering access to ballet instructors typically affiliated with prestigious ballet schools and companies worldwide.
The course content and structure are subject to change at the organisers' discretion to ensure the highest quality of instruction and experience.
4. It is the responsibility of participating candidates to obtain and hold all valid documentation required for the country in which they are traveling during the 'ART of - Event'.
5. The organisers are not responsible for organising travel or accommodation for the participants.
6. Participants are not permitted to attend the 'ART of - Events' if they are injured in any way.
7. The organisers must be informed if the participant has any allergies or other health problems, and an accompanying letter must be submitted at the time of participation.
8. All participants are required to attend in full ballet practice attire, including ballet flats and pointe shoes for female participants.
9. The organisers will not be held responsible for any damages or injuries that occur to any person during the 'ART of - Events', nor will they be responsible for the loss of any property.
10. Any and all choreographies, exercises, artistic works, or other creative outputs produced during the course/event are the exclusive intellectual property of 'Klymyuk, ART of'. Participants and third parties are not permitted to reproduce, share, or use this material for any purpose without prior written consent from the organisers.
11. The organisers reserve the right to retain the participation/course fee in full in the event of the applicant's withdrawal.
12. In case of injury or illness, the organisers reserve the right to retain all or part of the participation fee in the event of the applicant's withdrawal:
- In case of injury three months before the course begins, 50% of the course fee will be retained.
- If less than three months before the course begins, 70% of the course fee will be retained.
- If less than one month before the course begins, no course fee will be refunded; no exceptions will be made.
To be eligible for a partial refund, the candidate must present medical certificates from two different specialist doctors. Certificates from physiotherapists will not be accepted. All certificates must be officially certified documents and not handwritten.
13. The organisers reserve the right to change part of or cancel the event at any stage. If this occurs, the organisers will issue revised dates for the event. If the event cannot be rescheduled, they will refund participation/course fee paid, this excludes any extra cost, such as travel and accommodation expenses. If the applicant cannot attend under the new proposed dates, 50% of the participation/course fee will be reimbursed.
14. The organisers are released from any responsibility for non-fulfillment or improper fulfillment of their obligations under this Agreement if they prove that proper fulfillment was impossible due to force majeure, which means extreme, unforeseen, and unavoidable circumstances (e.g., epidemic, pandemic, lockdown, etc.). Participants accept that, due to these circumstances beyond the organisers' control, the event may be cancelled or interrupted without entitlement to any reimbursement, including course/participation fees.
15. The organisers shall not be liable for any indirect, consequential, or incidental damages arising out of or related to participation in the 'ART of - Events'.
16. Participants agree to indemnify and hold harmless 'Klymyuk, ART of', its employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to their participation in the 'ART of - Events', including but not limited to claims arising from injuries, property damage, or third-party actions.
17. The organisers reserve the right to change teachers or artists in the event of illness or any other unavoidable cause.
18. The application fee is not included in the participation/course fee, must be paid upon submitting the application form, and cannot be reimbursed under any circumstances.
19. The final schedule for the 'ART of - Ballet Winter or Summer Course/Stage de Danse D’été' shall be posted on the notice board on the first day of the event.
20. The Media Service (photo shoot or full package) option cannot be cancelled later than three months before the course begins.
21. To be eligible for the professional dancer course (discount), the professional dancer must currently be or have been under contract with a professional dance company for more than one year.
22. The participation/course fee must be paid within two weeks of receiving the confirmation letter but no later than the application process deadline.
23. It is recommended that participants take out personal travel insurance when traveling abroad.
24. Photo and video content are the property of 'Klymyuk, ART of' and may be used freely by 'Klymyuk, ART of' for promotional, educational, and marketing purposes. Participants waive any rights to royalties or other compensation arising from the use of this content.
25. All participants must have valid health insurance.
26. All participants must have valid liability insurance.
27. All participants under 18 years of age must submit a completed and signed 'Authorization for Underage Person' by their parents or legal guardian before the event begins.
28. By submitting personal information as part of the application process or during participation in 'ART of - Events', participants consent to the collection, processing, and storage of their personal data by 'Klymyuk, ART of' in accordance with applicable data protection laws. Personal data will only be used for event organisation, communication, and promotional activities and will not be shared with third parties without prior consent.
29. Refunds, if applicable, will be processed within 30 days of the event's cancellation or the participant's withdrawal, once all necessary documentation has been reviewed and approved by the organisers.
30. These Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland/Zurich. Any legal action or proceeding arising under or related to this Agreement shall be brought exclusively in the courts of Switzerland/Zurich.
31. 'Klymyuk, ART of' reserves the right to adjust and update the Terms and Conditions at any time. Any updates will take effect immediately upon issuance of the document.
